Following the conclusion of last year ' s OPE investigation in Osakidetza, signs of crime have been found, according to the report of the Basque Country High Prosecutor, Carmen Adam. It indicates that tests were filtered to several people and that the people who presented to them were not chosen by objective criteria. The report shall be referred to a court for investigation by an examining magistrate and, where appropriate, who agrees to whom criminal responsibility is charged.

Nineteen, according to the trade unions, were the categories in which irregularities occurred. Osakidetza’s internal research, for its part, focused only on eight disciplines, but not on others. The Public Prosecutor's Office has identified these irregularities in eleven categories: Plastic Surgery, Anesthesiology, Cardiology, Digestive System, Angiology, Traumatology, Urology, Intensive Care, Emergencies, Microbiology and Vascular Surgery.

The Office of the Prosecutor has estimated three posts from the Osakidetza directorate: Deputy Director Xabier Balerdi, former Director of Human Resources Juan Carlos Soto and Director of Health Care Andoni Arzelai will be attended by the doctor. He has left it to the judge to determine their responsibilities and has asked three presidents to be called to testify. The Department of Health of the Basque Government has not pronounced itself at the moment, considering that it has not received the official notification.

The investigation began from the controversy that arose in the oppositions of last year. On the eve of the examination day of the specialty of Anesthesia, some applicants came to the notary with the names of those who would approve the examination. After the tests, it was possible to certify that the outnumbered persons were those designated by the candidates who went to vote with the notary. Several Osakidetza workers confirmed that job contract leaks are common in the OPE.
