- The fifth administrative court in Bilbao annuls an OPE of 181 seats. An opposition party has denounced that the score of the Basque country collected in the bases does not correspond to the law. The judgment adheres to the appeal and annuls the contest.
The City of Barakaldo launched an OPE to cover 181 jobs, which has been suspended, according to El correo. By the end of 2022, the Official Gazette of Bizkaia published the general and specific bases of the job offer, and an opponent has denounced the “high” score of the Basque Country by means of an appeal.
According to the judgment, the Basque knowledge score “does not coincide” with the law and is declared “null”. It has also received that it exceeds the level established by the Basque Civil Service Law, since for the first and second linguistic models it cannot exceed 10% of the total score, in this case the first one 12.5% and the second one 25%.
The court has not annulled only the requirement of knowledge of the Basque Country. In the bases defined in 2022 there were a number of criteria of professional experience that established that from 1 January 2016 it would be rated to those who were older in the City Hall. The recurrent opponent declares that it "does not conform" to law and that it "is discrimination". The judgment is recast and says that this is not justified and that it “does not understand” why the age of a job is devalued after six years.
