The Spanish National Audience has decided to "monitor" the Eguna Spa, but has not prohibited it
  • Judge Ismael Moreno has pointed out that the prohibition of the Eguna Spa could mean "a cut in human rights" in the Basque Country. It also failed to identify the reasons that led to the establishment of a crime that would lead to the adoption of preliminary measures. However, the judge has ordered that the Ospa Eguna, to be held in Bilbao, be "monitored".

The State Prosecutor’s Office asked the National Court to prevent Ospa Eguna, but this latter will not ban the initiative that is held every year in Alsasua (Navarra). In the last ten years, it has been the day on which the security forces of the Spanish State have asked for their departure.

Judge Ismael Moreno believes that there is no indication that a crime will be committed to prohibit the celebration of the celebration. It has also warned that this ban, which could lead to "a cut in human rights in the country".
