Judge orders to reopen the case of Real's amateur injured by the Ertzaintza

The Provincial Court of Gipuzkoa ordered the reopening of the case of the amateur of the Real Sociedad Amaia Zabarte, who was seriously injured in the match between the Real Sociedad and the Paris Saint-Germain on March 5, 2024.

According to the court, the videos and images that have appeared from the file of the case "collide frontally" with the version that the Ertzaintza has given in its atestado, according to News from Gipuzkoa. Last June the newspaper published a video showing the content of the video. There you see how Zabarte suddenly falls to the ground, after a projectile hit him in the head, and then an ertzaina kicks him in.

The court considers that there is "certain evidence" that the Real fan was injured with a foam shell, according to News de Gipuzkoa. Zabarte spent several days in a very serious state in the Intensive Care Unit (ICU), where he was admitted to prison. Thus, he has asked the Court of Investigation of Donostia-San Sebastián, which brings the case, to re-investigate the case.

This court already filed the case last May, as "there is no specific author" in the Ertzaintza investigation. Zabarte's defense, however, appealed for another police force to investigate the case: "Anyone else is going to do better, because you can't do worse," explained Efe a family member from Zabarte, who was optimistic.

The Ertzaintza, for its part, opened an internal investigation after the event, but, despite spending many months, the Department of Security has not provided criminal or disciplinary responsibilities in the case. Moreover, Counsellor Bingen Zupiria said in September that "it cannot be confirmed that it is a foam shell" that seriously injured the realist fan.
