The City Hall of Donostia-San Sebastian has adapted the municipal ordinance to legalize, among other things, the tourist apartments that are above the first floor. Until now they could only be on the first floor and as a consequence of the proposed modification in the General Plan of Urbanism, from the first floor they will also have access to tourist apartments. PNV, PSE and pp supported the change, while EH Bildu and Elkarrekin-Podemos voted against it.
The organization of the Urban Management of the City of Donostia-San Sebastián prevented the installation of tourist apartments above the first floor until 2018, but in March of the same year the City Council approved the regulations for the implementation of tourist apartments on the other floors. However, in January 2020, the High Court of Justice of the Basque Country laid down the rules.Although the legal services of the City Council filed an appeal against the resolution, the Spanish Supreme Court rejected the appeal.
Councillor of Urbanism, Nekane Arzallus, said that "some situations should be regulated quickly", but EH Bildu has denounced that "legal engineering" is being used to "favour owners of tourist apartments that are above the first floor". Elkarrekin Rub-Ahal dugu has also criticized the regulations and accused Podemos of "disobeying social mobilization, acting in favor of speculative interests". In this sense, they have pointed out that the promotion of measures in favor of tourist housing will increase the price of housing and renting the city, "to the detriment of the general interest".
On April 13, nine agents of Donostia/San Sebastian broadcast a joint statement denouncing the existence of 559 tourist apartments in Donostia-San Sebastián, and on May 22 they will hold a demonstration to denounce the "residential emergency" in the city and claim the "right to housing".
