A ruling supports the request for Euskera in two municipal posts in Donostia
  • A few days ago, a judge from the Donostia court rejected the requirement of profile B2 of Euskera for two Municipal Police jobs. On this occasion, the same judge supported the decision of the City of San Sebastian, pointing out that to access the positions of two municipal technicians of Cartographic Digitalization, level B2 is necessary.

The difference between the two judgments is explained by the judge. It has interpreted in the example of municipal officials that it is not necessary for all agents to have a linguistic profile in order to exercise the linguistic rights of citizens. On the contrary, the posts in the Cartographic Digitalization section are only two, and the judge argues that if one of the two technicians does not exist, the other should meet the linguistic rights of the citizens, so he has advocated that both positions have profile B2.

The worker who sued the City Council of San Sebastian alleged that the municipal decision violated article 23 of the Constitution, thus infringing the right of access to functions and public offices on an equal footing.

According to the information received by ETB, the judge has pointed out that among the duties inherent to the job of these municipal technicians is "the attention to the public and professionals in the consultations carried out on files of their competence", so the City Council has "the obligation" to guarantee the right of citizens to be attended in Euskera.

According to the judge's interpretation, in the section of Cartographic Digitalization there are only two workers, so it "makes sense" that the Basque language be requested for both places.

Concentration of Basque cultural activity

On the occasion of the resolution of the Agents’ jobs, a concentration will be held on Friday at 18:30 a.m. in Alderdi Eder de Donostia, opposite the City Hall. Following the protocol put in place by the Council, the Council itself and the Association of Euskaltzales of Donostia, Bagera, have called for their disagreement with the ruling. The concentration has been joined by the municipal political majority (PNV and EH Bildu) and the trade union majority (ELA, LAB and STEILAS).
