The Superior Court of Justice of Navarre opens a door to the consolidation of public intermediaries
  • The Social Chamber of the Superior Court of Justice of Navarre has agreed for the first time that the City of Pamplona must formalise a final contract to an interim worker for having passed the public job offer he made in his day and which, among other things, has been in the job for many years.

The worker, who works at the Municipal Hospital of Pamplona/Iruña, in 2004 passed the test of access to his established employment, but did not obtain a place. He has been working in the workplace for nine years. Now the Superior Court of Justice of Navarre has decided that the Administration will have to lay down, fundamentally, because it has passed the test that was originally set up for that post, because the place was for a definitive post, since it has been working in that post for years and also has its capacity to do so.

The high degree of temporality of public posts makes the matter relatively old in the Labour Courts and is accentuated when the European Union has expressly requested the Spanish State to reduce its high temporality in the administration. This kind of sentence has been customary in the social courts, but it is the first to be adopted by the Supreme Court of Navarra, which opens the door to many public administration workers in a similar situation.

Not only that, the lawyer who has carried out this case and many others similar, José Luis Beaumont, has pointed out to Diario de Noticias that the next challenge is to achieve the final one for people who have been working in the public administration for many years and who have demonstrated their definitive character and their ability to perform.
