The singer Black Ivory rap was tried last December in Pamplona (Navarra) by the lyrics of his songs. Accused of "collective threats" to local police and their families, the prosecution has been accepted by the judge, who has sentenced the singer to 25 months in prison. In addition, he has ordered to close his Youtube channel and has forbidden him to use similar media in the next three years. Now the defendant can appeal the sentence.
In particular, Black Ivory was prosecuted both by Fuck a Cripa 02 and by Atraco. "Run, magpie, kill the son of a munipa," and "If you kill a cop, kill five."
In the indictment, the prosecution argued that the singer "knew what he said in his song and took a threatening and intimidating attitude" referring to one of the video clips. He also associated letters with "hate" the police force. The prosecution recalled the case of singer Valtònyc rap, also tried and convicted of her letters, and noted that in both cases "the limits of freedom of expression are exceeded".
The judge of Pamplona has based his article 170 of the Penal Code. According to this article, a defendant can be punished "if the threats of a disease constituting a crime are to intimidate the inhabitants of a town, ethnic or cultural group, social or professional group and have the necessary gravity to achieve it".
