Ancora denounces to the Ertzaintza the "clandestine works" of the Fine Arts Building of San Sebastian
  • The Ancora Association has submitted a complaint to the Ertzaintza for the "clandestine works" being carried out in the Fine Arts Building. In fact, on September 30, Ancorá recorded a letter in the City Hall in which he denounced that the protected envelope of the Fine Arts Building had been destroyed by hammering “hidden behind an opaque canvas”. The association has also denounced that the City Council has not replied to the letter and that "clandestine works" are still in progress. In view of this, Ancorá has decided to lodge a complaint.

On October 8, the municipal architect Orruño published a report with the photographs of the Bellas Artes building, “to ratify the urban infraction”. According to them, on the second and third floors “no punctual and individualized expansions of voids have been carried out, but whole facade parts have been removed, which does not correspond to the provisions of the particular PERI standard”.

Ancora explained that these actions are not allowed either through the municipal license granted in September 2021, as “this license expressly excluded demolition works and subsequent reconstruction”.

Article 220 of the Law on Land and Urbanism of the Autonomous Community of the Basque Country states: “When the Mayor becomes aware by any means that clandestine works or uses are being carried out, he shall order the immediate suspension of them.” This suspension is regulated, so once the facts have been established, the municipal councillor must order the adoption of this measure, otherwise the authorities and public officials shall be liable for disciplinary action.

The association has stressed that the destruction of the listed goods is "a very serious infringement", according to Article 225 of the same law. “The City Hall must exercise its sanctioning powers and cannot be inhibited, as the Ararteko recalls in its resolution of 9 September 2024, as well as the Municipal Secretary’s own legal report of 3 October,” Ancorá said.

However, Ancorá has denounced that instead of paralysing the works, “clandestine works advance substantially”, as seen “by the recent installation of a new dome”, instead of the original destroyed by the promoter society in October 2015.

The association has recalled that the Fine Arts Building is the only one with an International Heritage Alert in the State.
