A lender wants to evict an 80-year-old usurbildarra with an abusive clause
  • The son of the usurbildarra María Angeles 80-year-old asked for a loan from Madrid Reno AsumentSL, using as an endorsement his mother's house already paid. Taking advantage of an abusive clause, along with the non-payment of three instalments, Reno appealed to the courts to auction the house. The Stop Deshaucios platform is fighting to slow down the process.

The lender in Madrid uses the early maturity clause to initiate eviction. This clause has been declared null and void by the European Court of Justice. On the contrary, when the son of María Ángeles went to the court, whose son is currently dead, the judge did not declare him null. Thus, in April 2021, the 80-year-old usurbildarra received the news that his house was to be auctioned because three installments had not been paid.

In the eviction process, the Stop Evictions platform has asked the judge to ask the lender about the amount of outstanding assessed contributions to date, in order to negotiate, by paying them, solutions to settle the debt, postpone the auction and stay at home in María Angeles.

The son asked for a loan of 60,000 euros, but it is clear that the house of 90 square meters of the usurbildarra has more value.

The tragedy of the avalists

“We want to denounce the tragedy of the avalists, the drama of the retired elderly, whose home, which has already been paid, has often become a guarantee for the loans of their children. On the platform we have six victims of these cases,” explains Stop Kaleroak. “Housing is a right, not a business. We will not accept this eviction, the aim is for Maria Angeles to continue living in her house until the last day, and to do so we will use all judicial means, citizen mobilization and institutional mediation”. The platform wanted to highlight the support that the Mayor of Usurbil, the representatives of EH Bildu and Elkarrekin Podemos IU, the LAB and ESK unions, and the pensioners’ collective are having in this matter.
